Terms & Conditions to Ship to Oman

Thanks for using our products and services ("Services"). The Services are provided by Asyad Express LLC, located at Airport Heights, Asyad Fulfilment Centre, Al Seeb, Muscat Provence, Sultanate of Oman. By using our Services, you are agreeing to these terms. Please read these Terms and Conditions (Terms” “Terms and Conditions") carefully before using the (http://www. ShipYourCart.com) website and the mobile application (the "Service*) operated by [Oman Post,Asyad Express] ("us", "we", or "our"). Our Services are very diverse, so sometimes additional terms or product requirements (including age requirements) may apply. Additional terms will be available with the relevant Services, and those additional terms become part of your agreement with us if you use those Services,

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer notice, and any or all Agreements: "Client", "You" and "“Your" refer to you, the person accessing this website and accepting the Company's terms and conditions. "The Company” “Ourselves", "We" and "Us" refer to our Company. "Party", "Parties" or "Us" refers to both the Customer and ourselves, or either the Customer or ourselves. All terms refer to the offer, acceptance, and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether through formal meetings of a fixed duration, or by any other means, with the express purpose of meeting the Client's needs in terms of providing the Company's declared services / products, in accordance with and subject to applicable laws. Any use of the above terminology or other words in the singular, plural, capital letters and/or plural, and/or these terms, is considered interchangeable and therefore reference to them.

2. USING OUR SERVICES

You must follow any policies made available to you within the Services. Don't misuse our Services. For example, don't interfere with our Services or try to access them using a method other than the interface and the instructions that we provide. You may use our Services only as permitted by law, including applicable export and re-export control laws and regulations.

We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct. Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access. You may not use content from our Services unless you obtain permission from its owner or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in our Services. Don't remove, obscure, or alter any legal notices displayed in or along with our Services. In connection with your use of the Services, we may send you service announcements, administrative messages, and other information. You may opt out of some of those communications. Some of our Services are available on mobile devices. Do not use such Services in a way that distracts you and prevents you from obeying traffic or safety laws.

We are committed to protecting your privacy. ShipYourCart's privacy policies explain how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that ShipYourCart can use such data in accordance with our privacy policies. Only authorized employees within the company who, in the course of their duties, can access and use information collected from individual customers. We are constantly reviewing our systems and data to ensure the best possible service to our customers. Government authorities have created specific offences for unauthorized actions against computer systems and data. We will investigate such actions with a view lo bringing legal action and/or civil action for damages against those responsible.

If you wish to purchase any product or service made available through the Service ("Purchase"),

ShipYourCart gives you a personal, worldwide, royalty-free, non-assignable and non- exclusive license to use the platform provided to you by ShipYourCart as part of the Services. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by ShipYourCart , in the manner permitted by these terms You may not copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. VAT will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in Omani Rials.

You agree to pay all charges at the prices with VAT then in effect for your purchases and any applicable shipping fees, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order. 

We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment. We reserve the right to refuse any order placed through the Site. We may, in our sole discretion, limit or cancel items number per person, per household, or per order.

These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. 

We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

6. DISCLAIMER

1. Exclusions and Limitations

The information contained on this website is provided on an " as is " basis. To the fullest extent permitted by law, this company: excludes all representations and warranties with respect to this website and its content or that are or may be provided by affiliates or any other third party, including with respect to any inaccuracy or omission in this website and/or the Company's documentation; and excludes any liability for damages arising out of or in connection with your use of this website.

 ShipYourCart , and ShipYourCart's suppliers and distributors, will not be responsible for lost profits, revenues, or data, financial losses or indirect, special, consequential, exemplary, punitive damages or damage caused to your computer, computer software, systems and programs and data relating thereto or any other direct or indirect, consequential or incidental damages.

7. LIABILITY FOR OUR SERVICES

To the extent permitted by law, the total liability of ShipYourCart , and its suppliers and distributors, for any claims under these terms, including for any implied warranties, is limited to the amount you paid us to use the Services. In all cases, ShipYourCart , and its suppliers and distributors, will not be liable for any loss or damage that is not reasonably foreseeable. The above exclusions and limitations apply only to the extent permitted by law. We recognize that in Oman,  you might have legal rights as a consumer. None of your legal rights as a consumer are affected waived by contract.

8. BUSINESS USES OF OUR SERVICES

If you are using our Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify ShipYourCart and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys' fees.

9. USER REGISTRATION

You may be required to register with the Site in order to access. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

10. CANCELLATION POLICY

10.1 30 days’ notice of account cancellation is required. Such notice may be given, by email only, and will be accepted subject to written confirmation. We reserve the right to charge a cancellation fee to cover any administrative costs. 

10.2 cancelation of account can be processed only when no shipments are in customer account and any shipments received after the account cancelation will be immediately destroyed.

11. Prohibited, Restricted and Dangerous goods: 

We will not carry

11.1 You understand and agree that we will not carry, and you must not try to ship:

i. Any items classified as hazardous material, Dangerous Goods, articles that are prohibited or restricted by IATA (International Air Transport Associated), ICAO (International Civil Aviation Organization), or any applicable government department or other relevant organization; or

ii. firearms, bullion, works of art, negotiable instruments in bearer form, jewelry, precious metals, precious stones, lewd obscene or pornographic material, currency, stamps, deeds, hazardous or combustible material or other Dangerous Goods, cashier’s cheques, money orders, travelers' cheques, industrial carbon and diamonds, antiques, plants, or animals; or

iii. Government IDs and licenses, or items that claim to be, or that look like, government identification documents or other government issued documents. This includes uniforms, and badges or patches designed to look like official government-issue.  

11.2 Prohibited or restricted shipments, including shipments containing Dangerous Goods, will be forfeited, destroyed, or provided to government officials.

11.3 Notwithstanding anything to the contrary, ShipYourCart acceptance of any shipment containing Dangerous Goods does not mean that such shipment conforms to the applicable laws and regulations. You will be solely responsible for the compliance of the shipment with the applicable laws and regulations, in particular IATA Dangerous Goods Regulations, including but not limited to, the effective and sufficient packaging, packing, classification, and documentation of the shipment. You are responsible to ensure that the shipment is acceptable for carriage and entry into the destination country or territory. All charges incurred for the carriage to and from countries or territories where entry is not permitted will be your expense. You will be liable for and shall defend, indemnify and hold harmless ShipYourCart from all liability and/or claims against it based on injury to any person, damage or loss of property, or any other damage arising from any product liability, inadequate packing, mislabeling, wrongful information, description or declaration you provide and for any other claim relating to the shipment or its carriage.

11.4 Animal skins, furs, feathers, hair, wildlife (from US): You accept and acknowledge that any shipments to be exported from the US that contain animal skin, furs, mink, alligator skin, python skin, feathers (including hair accessories) or any other wildlife will be held at the US Customs Department for inspection and may be seized or confiscated. You acknowledge and agree that you alone are liable for any costs involved if you try to export such items and that ShipYourCart will not compensate you for such seized or confiscated shipments.

11.5 all the items that are restricted and prohibited as per the list HERE will not be shipped and ShipYourCart has the authority to destroy such items received. 

11.6 some items have excepted quantities of dangerous goods element and can be shipped but needs special handling and accordingly will Apply dangerous goods fees and the customer is responsible of confirming with ShipYourCart customer service weather the item can be shipped or not. 

12. Value and weight limitation:

12.1 Value Limitations:
a. If the package contents of the same category exceed the declared value of US $2500, and an export document called SED (Shippers Export Declaration) must be processed.
B. The cost of preparing this document is US $30 to be added to the costs of that shipment.

12.2 Weight and Volume Limitations:
There is no weight limit; however, if your package is more than 200 lbs. Please contact Customer Service for additional information. Moreover, all shipments above 25 KG (actual or volumetric) will have to be collected from ASYAD fulfilment center only by the customer.

13. WAREHOUSING LIMIT: 

1. warehousing in detitanation country : In case customer doesn’t collect his shipment within 30 days of the shipment arrival in Oman, ShipYourCart , reserve the right to dispose of the shipments as they see fit .
2. warehousing in origin country: we provide 30 days of free warehousing and another 30 days of paid warehousing whereby ShipYourCart applies a daily fee to the customer and is entitled to deduct it from the customer's wallet. after 60 days, ShipYourCart , reserves the right to dispose of the shipments as they see fit.

13. RETURN

14.1 As we only provide for an Item to be shipped from the virtual address to your Delivery Address, we shall not in any way be involved or concerned with any claim for refund, return, rebate, or exchange of any Item in the Shipment. You shall liaise and deal directly with the Seller in respect of any refund, return, rebate or exchange, and money-back guarantee policies and procedures which will be in accordance with the Merchant's policies and procedures.

14.2 For exchange or return of an Item, you shall arrange to send the Item back to the Seller at your own cost. ShipYourCart may at its sole discretion but is not obliged, to advice on a service to use for exchanging or returning Items.

‍

14.3 For return of an Item to a Seller while the Item is still in the (US, Turkey, and UK) Source Country, you may arrange for the return of the Item by requesting the service of domestic return through your account and we are not accountable for the seller/receiver collections. This return will be subject to a service charge and domestic delivery cost. If the Seller provides a free domestic return, you must provide us with a return sticker. Notwithstanding any free domestic returns, you shall be responsible for all service charges. We cannot be accountable with the above-mentioned clauses, unless the seller warehouse within the same country (US, Turkey, and UK). The return request should be within the 30 days free storage, or the shipment will occur the warehousing fees per everyday past the 30 days. 

15. REFUND

1. No refund will be offered when a service is deemed to have commenced and is, for all intents and purposes, in progress. Any amount paid to us that constitutes payment for the provision of unused Services will be refunded if the item is insured only.
2. Any notice, request, or any other correspondence in connection with these Conditions shall be in writing and sent by email to the address specified in Website, or to any other address as earlier informed to us in writing.
3.  Any claim for loss or damage,” delay not included”, when the shipment received in Oman must be:(a) made within three (3) days from the date of delivery; (b) in writing; (c) accompanied by the original copy of the consignment note, any supporting documents, invoices or receipts; (d)refund will be only in the form of credit In the Customer Wallet; (e) for insured shipments only; (f) refund within 30 working days; and (g) submitted to: ShipYourCart@asyadexpress.com.
4. Any claim for loss or damage,” delay not included” for part of the shipment , when the shipment received in Oman must be:(a) made within three (3) days from the date of delivery; (b) in writing; (c) accompanied by the original copy of the consignment note, any supporting documents, invoices or receipts; and (d) refund will be only in the form of credit In the Customer Wallet; (e) for insured shipments only; (f) refund within 30 working days; and (g) added services not refunded ; (h) submitted to: ShipYourCart@asyadexpress.com.

5. Any claim for termination of the service or system error, must be:(a) made within 2 days from the date of confirmation of service or error; (b) in writing; (c) accompanied by the original copy of the consignment note, any supporting documents, invoices or receipts; and (d) submitted to: ShipYourCart@asyadexpress.com.

16. EXCEPTIONS

17. WALLET

1. Wallet tops up is a service provided by ShipYourCart to facilitate the storage of money, the sum of this money, minus any purchase, will be reflected as your Wallet top up balance.
2. The balance credited to the Wallet top up cannot be refunded as a cash or    transferred to the bank account or card for any reason.
3. All unused credits will be returned when the customer cancels the account within 60 working days subject to customer providing all account details. 
4. If there is an error in the processing of any transaction to the wallet, you authorize us to initiate debit or credit entries to your designated bank account, to correct such error, provided that any such correction is made in accordance with applicable laws and regulations. If we are unable to debit your designated bank account for any reason, you authorize us to resubmit the debit, plus any applicable fees, to any other bank account or payment instrument that you have on file with us or to deduct the debit and applicable fees from your wallet top up balance.
5. You authorize Asyad express to initiate debit or credit entries to your wallet top up:

1. Where wallet top up has determined that you have engaged in fraudulent or suspicious activity and/or transactions.
2. In connection with any lost, damaged, or incorrect items

                        (iii)      In connection with any uncharged fees

18. PROHIBITED ACTIVITIES

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. As a user of the Site, you agree not to Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us. Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.

1. Circumvent, disable, or otherwise interfere with security-related features of the Site, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Site and/or the Content contained therein.
2. Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Site. Use any information obtained from the Site in order to harass, abuse, or harm another person.
3. Make improper use of our support services or submit false reports of abuse or misconduct. Use the site in a manner inconsistent with any applicable laws or regulations. 
4. Engage in unauthorized framing of or linking to the Site. 
5. Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party's uninterrupted use and enjoyment of the Site or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Site. 
6. Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
7. Delete the copyright or other proprietary rights notice from any content 
8. Attempt to impersonate another user or person or use the username of another user.
9. Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats ("gifs"), 1x1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as "spyware" or "passive collection mechanisms" or "pcms"). 
10. Interfere with, disrupt, or create an undue burden on the Site or the networks or services connected to the Site. 
11. Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the platform Offerings to you. 
12. Attempt to bypass any measures of the Site designed to prevent or restrict access to the Site, or any portion of the Site. 
13. Copy or adapt the Site's software, including but not limited to Flash, PHP, HTML, JavaScript, or other code. 
14. Except as permitted by applicable law, decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site. 
15. Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Site, or using or launching any unauthorized script or other software. 
16. Use a buying agent or purchasing agent to make purchases on the Site. 
17. Make any unauthorized use of the Site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses. Use the Site as part of any effort to compete with us or otherwise use the Site and/or the Content for any revenue-generating endeavor or commercial enterprise.

19. USER DATA

We will maintain certain data that you transmit to the Site for the purpose of managing the performance of Site, as well as data relating to your use of Site. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Site. You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.

20. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

Visiting the Site, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communication be in writing. 

You hereby agree to the use of electronic signatures, contracts, orders, and other records, and to electronic delivery of notices, policies, and records of transactions initiated or completed by us or via the site. 

You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances,     or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits by any means other than electronic means.

21. SUBMISSIONS

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information regarding the Site ("Submissions") provided by you to us are non-confidential and shall become our sole property. 

We shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you. You hereby waive all moral rights to any such Submissions, and you hereby warrant that any such Submissions are original with you or that you have the right to submit such Submissions. 

You agree there shall be no recourse against us for any alleged or actual infringement or misappropriation of any proprietary right in your Submissions.

22. SITE MANAGEMENT:

We reserve the right, but not the obligation, to: 

1. Monitor the Site for violations of these Terms of Use. 
2. Take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms of Use, including without limitation, reporting such user to law enforcement authorities. 
3.  In our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof, 
4. In our sole discretion and without limitation, notice, or liability, to remove from the Site or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems, and 
5. Otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site.

There may be information on the Site that contains typographical errors, inaccuracies, or omissions that may relate to the Site, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time, without prior notice.

24. DELIVERY

1. An Item will only be delivered to your delivery address. the speed of delivery is subject to the address correct information. 
2.  Oman post and Asyad express will make reasonable effort to deliver the Item within the time frame indicated on Site, subject to delays in high security locations and force majeure. We will not be liable for any delay in delivery for whatever reason.
3. An Item shall be delivered to the customer designated delivery address, but not necessarily to the named customer personally.
4.  You may login into your account to check the delivery status of the order.

25. LOG FILES

We use IP addresses to analyze trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. Additionally, for systems administration, detecting usage patterns and troubleshooting purposes, our web servers automatically log standard access information including browser type, access times/open mail, URL requested, and referral URL. This information is not shared with third parties and is used only within this Company on a need-to-know basis. Any individually identifiable information related to this data will never be used in any way different to that stated above without your explicit permission.

30. FORCE MAJEURE

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, pandemic, epidemic, flood or any other natural or manmade eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavors to comply with the terms and conditions of any Agreement contained herein.

31. WAIVER

Failure of either Party to insist upon strict performance of any provision of this or any Agreement or the failure of either Party to exercise any right or remedy to which it, he or they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any Agreement. No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.

24.6 If it turns out that a particular term is not enforceable, this will not affect any other terms.

33. APPLICABLE LAW AND JURISDICTION

These terms shall be governed by and defined following the laws of Sultanate of Oman. Oman post, Asyad express and yourself irrevocably consent that the courts of Oman shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

34. INSURANCE 

The customer is compensated for his property in the following cases:

• loss or damage caused by improper use of the insured property, whether owned by the customer.

• Loss or damage caused by negligent acts for insured property only. 

• Loss or damage caused by explosive or flammable materials or materials stored in Insured property.

35. UNDERINSURANCE

32.1. If the loss or damage to the Insured Properties is greater than the insurable

amount in this Agreement, the Client agrees to bear the excess of the cost of the value of the

Properties or damage.

32.2. Unless the customer insured the shipment he will not be entitled to any kind of compensation

32.3. Indirect compensation will not be applicable.

32.4. Compensation does not cover delays.

32.5. refund will be within 30 days to the customers wallets only.
